Workers’ comp stakeholders may have received an early Christmas present when the “PAID Act” (Provide Accurate Information Directly) was signed into law on December 11.

As we all know, workers’ comp payors/insurers have to reimburse Medicare when the federal health program pays expenses that should have been part of an injured worker’s claim. Prior to the PAID Act, insurers had to wait for claimants to alert them if and when they were covered by Medicare.

Louise Esola, writing in Business Insurance, explains how this new law requires the Centers for Medicare and Medicaid Services to present enrollee data to workers’ comp insurers. Privacy laws had previously banned CMS from disclosing this information.

The bottom line, hopefully, will be that insurers have an earlier and more accurate picture of future expenses to reimburse. Knowing the facts eliminates surprises and helps our industry do better.
