You Can Tell He’s Lying…When His Lips Are Moving

At law school, we were taught how to “plead the alternative.” The classic example centers around a lawsuit because of a dog bite. The defense may counter as follows:

  • My dog doesn’t bite;

  • My dog is always on a leash;

  • I don’t think you really got bit;

  • I don’t own a dog.

A West Virginian judge recently granted a request to shut down a pain clinic with a questionable track record. After reading the owner’s responses in the Associated Press, it seems this physician has mastered the art of pleading the alternative:

  • We are not a pain clinic;

  • My clinic is closed;

  • I don’t operate a pain clinic;

  • I treat chronic degenerative disease;

  • Most of my patients don’t get opioids;

  • We deal with public health issues.

Fortunately, the Department of Health and Human Resources has taken this dog to the pound.
