At law school, we were taught how to “plead the alternative.” The classic example centers around a lawsuit because of a dog bite. The defense may counter as follows:
A West Virginian judge recently granted a request to shut down a pain clinic with a questionable track record. After reading the owner’s responses in the Associated Press, it seems this physician has mastered the art of pleading the alternative:

We are not a pain clinic;

My clinic is closed;

I don’t operate a pain clinic;

I treat chronic degenerative disease;

Most of my patients don’t get opioids;
-
We deal with public health issues.
Fortunately, the Department of Health and Human Resources has taken this dog to the pound.
